In the couple first seconds of the vid I was still convinced it was a spider despite what the narrator was saying. It looks like a spider but also moves like one! Add to that, that the snake perfectly blends with its surrounding to the point where you can't possibly spot it. Incredible.

Zoro is only assumed to be the second-in-command here by another character in-universe. This does not necessarily translate to canonical fact or reflect true author intent.

Does Zoro actually ACT like he's the de facto second-in-command? Or is he nothing more than just the second strongest member of the crew after Luffy?

In shounen series this is usually reserved for the de facto second-in-command or second strongest member of the main character team.

I don't know. The case hasn't been talked about in mainstream news much other than a few articles just detailing the case and charges against Trollswami. As far as I know, it might still be ongoing or settled out of court. The latter is far more likely.
